By downloading, installing, accessing, or using the Live Subtitles application (the "Software"), provided by Live Subtitles (the "Service Provider", "we", "us", "our"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not install or use the Software.
Subject to these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for your personal or internal business purposes.
You may not: (a) copy, modify, or create derivative works of the Software; (b) reverse engineer, decompile, or disassemble the Software except to the extent permitted by applicable law; (c) rent, lease, sublicense, sell, or otherwise transfer the Software; (d) remove or alter any proprietary notices.
Live Subtitles provides real-time speech recognition, captioning, and translation functionality on supported platforms (Windows, macOS, Android, iOS). The Software may rely on third-party services (including Google, Yandex, and OpenAI) to perform speech recognition and translation.
You must be at least 18 years old or the age of legal majority in your jurisdiction to purchase paid services. You are responsible for maintaining the confidentiality of any credentials and for all activity that occurs under your account.
Certain features of the Software require payment. The Software operates on a credit ("minutes") and/or subscription model. Prices are displayed at the point of purchase. By completing a purchase, you authorize the applicable payment processor to charge your payment method for the amount shown.
Payments are processed by third-party providers, including Paddle.com Market Ltd, which acts as the Merchant of Record for online purchases. Paddle's own terms apply in addition to these Terms for transactions handled by Paddle. Microsoft Store purchases are governed by the Microsoft Store Terms of Sale.
Minutes and other consumable credits do not expire unless explicitly stated at the time of purchase, but are non-transferable.
Refunds are handled in accordance with our Refund Policy, which forms an integral part of these Terms.
You agree not to use the Software:
The Software, including all code, design, graphics, and trademarks, is owned by the Service Provider or its licensors and is protected by intellectual property laws. No rights are granted to you other than the limited license set out in Section 2.
The Software integrates third-party speech recognition and translation services. Your use of those services may be subject to additional terms of those providers. We are not responsible for the availability, accuracy, or content of third-party services.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSCRIPTIONS OR TRANSLATIONS WILL BE ACCURATE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
We may suspend or terminate your access to the Software at any time for breach of these Terms or for any other reason permitted by law. Upon termination, your license to use the Software ends, but the provisions that by their nature should survive (including Sections 8, 10, 11, and 14) will continue in effect.
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Effective Date". Continued use of the Software after the changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to its conflict of laws principles. Mandatory consumer protection laws of your country of residence remain unaffected.
