Terms of Service

1. Acceptance of Terms
By downloading, installing, accessing, or using the Live Captions application (the "Software"), provided by Live Subtitles (the "Service Provider", "we", "us", "our"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not install or use the Software.
2. License Grant
Subject to these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, solely for your personal or internal business purposes.
You may not: (a) copy, modify, or create derivative works of the Software; (b) reverse engineer, decompile, or disassemble the Software except to the extent permitted by applicable law; (c) rent, lease, sublicense, sell, or otherwise transfer the Software; (d) remove or alter any proprietary notices.
3. Description of the Service
Live Captions provides real-time speech recognition and captioning on Windows 10 and Windows 11: it shows the speech from your computer's sound or your microphone as text in the language being spoken, labels different speakers, and keeps a transcript history on your device. The Software does not translate speech. It relies on a third-party cloud speech recognition service (Soniox) and requires an internet connection.
Captions are generated automatically and may contain errors, omissions or delays. Do not rely on them as your only source of information in medical, legal, emergency or other situations where a mistake could cause harm.
4. Eligibility
You must be at least 18 years old or the age of legal majority in your jurisdiction to purchase paid services. The Software does not require an account; purchases are linked to your installation of the Software.
5. Paid Services, Minutes, and Subscriptions
The Software includes a free trial of 20 minutes of captions per device. After that, captions require minutes, which are available as one-time minute packs or as subscriptions with a monthly minute allowance. Minutes are counted only while captions are running. Prices are displayed at the point of purchase and include applicable taxes. By completing a purchase, you authorize the payment processor to charge your payment method for the amount shown.
Payments are processed by Paddle.com Market Ltd, which acts as the Merchant of Record for online purchases. Paddle's own terms apply in addition to these Terms for transactions handled by Paddle.
Minutes from one-time packs do not expire unless explicitly stated at the time of purchase, but are non-transferable. Subscriptions renew automatically at the end of each billing period until cancelled; the minute allowance of a subscription is provided for each billing period as described at the time of purchase.
6. Refunds
Refunds are handled in accordance with our Refund Policy, which forms an integral part of these Terms.
7. Acceptable Use
You agree not to use the Software:
- For any unlawful purpose, or in violation of any applicable law or regulation;
- To record or transcribe communications without the consent of all parties where such consent is required by law;
- To harass, abuse, or harm another person;
- To attempt to gain unauthorized access to the Software, our servers, or any related systems;
- To interfere with or disrupt the integrity or performance of the Software.
8. Intellectual Property
The Software, including all code, design, graphics, and trademarks, is owned by the Service Provider or its licensors and is protected by intellectual property laws. No rights are granted to you other than the limited license set out in Section 2. The transcripts you create belong to you.
9. Third-Party Services
The Software integrates a third-party speech recognition service. Your use of that service may be subject to additional terms of its provider. We are not responsible for the availability, accuracy, or content of third-party services.
10. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CAPTIONS OR TRANSCRIPTS WILL BE ACCURATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SOFTWARE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Termination
We may suspend or terminate your access to the Software at any time for breach of these Terms or for any other reason permitted by law. Upon termination, your license to use the Software ends, but the provisions that by their nature should survive (including Sections 8, 10, 11, and 14) will continue in effect.
13. Changes to the Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised "Effective Date". Continued use of the Software after the changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to its conflict of laws principles. Mandatory consumer protection laws of your country of residence remain unaffected.
